Terms of Services

1 Area of application

These General Terms and Conditions (hereinafter referred to as GTC) govern the contractual relationship between Nutritious and the Customer in the version valid at the time of the business relationship. The GTC shall apply to all services provided by Nutricious and may be amended at any time. Such amendments shall come into force immediately upon publication on this website and shall apply to all orders from that time onwards.

2 General

By placing an order, the customer agrees to the GTC.

3 Business activity

Nutricious produces personalized meals on the basis of the nutritional plan drawn up in the assessment beforehand and delivers them packed in glass containers in a cool bag. Orders can only be placed after the nutritional assessment has been completed and by agreement with Nutricious.

4 Prices

Prices are quoted in CHF. Delivery costs are included in the meal prep prices, but it has to be noted that additional fees due to higher fuel prices or other circumstances impacting delivery expenses (e.g. delivery location) may be applicable. All price quotations and price lists are non-binding; price adjustments are therefore possible at any time without prior notice and without giving reasons. Subject to pricing errors, the prices published on the website on the order date shall apply.

5 Payment

Payment for the nutritional assessment can be made either directly in cash or via Twint. Payment for meal prep can be made either via bank transfer or Twint. Invoices for meal prep must be paid until at least 3 days before the scheduled meal prep delivery. The invoice is being sent to the customer via E-Mail or Whats App and contains all account details as well as instructions.

We expressly point out that in order to save costs we do not send invoices with payment slips by post. Payment slips for cash deposits via the post office must be explicitly requested from us. The costs for the cash deposit will be passed on.

6 Delivery times / delivery window / receipt of delivery

The delivery time of each delivery is agreed individually with each customer in advance. Until delivery, Nutricious guarantees that the cold chain has been maintained, after which the recipient is responsible for ensuring refrigeration.

The ordering party agrees to personally accept delivery on the selected delivery day within the agreed delivery window. If it is not possible for her/him to receive the bag at the selected address for any reason, the supplier may deposit the bag at the risk of the customer. If possible, a suitable location will be chosen for this purpose. In any case, however, the purchaser shall be responsible for ensuring refrigeration after deposition. A delivered meal prep must be paid for in full in all cases. Refunds, exchanges or reductions are excluded.

7 cooling bags / cooling elements

We make our food containers, cooling bags and cooling elements available to the ordering party on a loan basis. They therefore always remain the property of Nutricious. If a bag cannot be received personally, Nutricious can fit the bag with additional cooling elements at the express request of the ordering party. In exceptional cases, up to 2 cooling elements may be requested so that cooling in the bag can be guaranteed for up to 3h. According to point 6, Nutricious is no longer responsible for maintaining the cold chain and is therefore not liable. The customer agrees to return the cooling bag with the next meal prep delivery as well as the cooling elements in a reusable condition. This can be done in the following way.

8 Cancellation / Adjustment of Orders

Orders placed can be changed or completely cancelled until 48 hours before 20 pm on the scheduled and agreed delivery day, either by e-mail to info@nutricious.ch or by telephone on 078 237 31 34. Cancellations or adjustments after the acceptance deadline will not result in a release from the obligation to pay, as the production of the meals has already started. In such cases, Nutricious will always endeavour to find a solution, but in the event of hardship, the entire order must be paid for in full by the ordering party.

9 Retention of title

The food delivered by Nutricious shall remain the property of Nutricious until acceptance of delivery or their deposit (see clause 6). Thereafter they shall be the property of the Purchaser. The cooling bag, the cooling elements and the food containers as well as any other transport containers shall remain the property of Nutricious and must be returned in accordance with point 7.

10 inspection and acceptance of our delivery

Nutricious shall inspect and pack all meals with the greatest care. The Customer shall inspect the delivery immediately upon receipt. Damaged menus or improper refrigeration must be checked and objected to immediately in the presence of the supplier. In addition, a complaint must be made immediately to Nutricious by e-mail to info@nutricious.ch or by telephone on 078 237 31 34. If no complaint is made immediately, the delivery shall be deemed to have been made without defects. Refunds, exchanges or reductions are therefore excluded.

11 Communication

Experience has shown that Nutricious uses What's App as the first communication channel. The accessibility is high. The channel is free of charge. There is no spam filter. This way Nutricious can ensure that the delivery times communicated according to point 6 are also seen. Of course, there is no obligation to use What's App. If a customer does not wish to be contacted by mobile phone, he or she can indicate this by providing a landline number. In this case, communication will take place via the specified e-mail address. By providing the mobile phone number, the Ordering Party consents to Nutricious using this as the first communication channel. Of course, this consent can be revoked at any time without giving reasons. If the mobile phone number is recorded again for a future order, the revocation shall be deemed invalid and Nutricious shall use this communication channel.

12 Right of return

As Nutricious cooks personalized meals to order in advance, there is in principle no right of return. Orders may be modified or cancelled in accordance with point 8.

13 resale

Resellers of any kind are obliged to comply with all legal regulations concerning the sale of food. The necessary permits, hygiene concepts and controls must be obtained or drawn up independently. Nutricious can neither control this nor provide binding canton-specific information.

14 Liability

Despite the utmost care taken by Nutricious and its suppliers, we cannot fully exclude the possibility that foreign objects may be contained. Nutricious accepts no responsibility or liability for links to other sites and their content. The use of the website is at the user's own risk. Liability is in any case limited to the total value of the delivery. Unless otherwise defined in these GTC, we shall only accept liability in the event of gross negligence on the part of our employees, missing products, failure of deliveries or effective quality defects of our products which are objected to in accordance with point 9. We accept no liability for the aesthetic or culinary pleasingness of our products and services, provided that these are within our usual standards, or for the adequate satiation of the customer or his customers or guests. Should our service fail for any reason whatsoever, we accept no liability whatsoever. Claims for damages in respect of property damage and financial loss against Nutricious are excluded.

15 Severability clause

Should parts of these General Terms and Conditions prove to be unenforceable or invalid for any reason, this shall not affect the validity of the remaining provisions.

16 Law

Swiss law shall apply, the place of jurisdiction shall be Baar (as of 2022).
